Terms of Service.

In short

1. Who we are and this agreement

The Doing Dad (thedoingdad.com) is run by The Doing Dad LLC, a Utah limited liability company ("we," "us"). These terms are an agreement between you and us. By starting a trial or a paid plan, or by using the service, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the service.

2. What the service is

Each day you choose, we email you one idea for something to do with your kids. Ideas come from a hand-written library that people write and review. Software picks the idea for the day based on your kids' ages and interests, the season, and the local weather. We don't use AI to write ideas on the fly.

The daily emails are the service itself. You can pause or stop them from the footer of any email.

3. Who can use it

You must be an adult (18 or older) to create an account. The account is for you, the parent or caregiver. Children don't use the service and can't have their own accounts. You may give us limited information about your own kids so we can pick ideas that fit them. See our Privacy Policy for what we collect and how you can delete it.

4. Your account

Please give us a real email address you control and keep your details current. You sign in with a link we email you, and a cookie keeps you signed in. You're responsible for activity on your account, so keep access to your email secure. Tell us at hello@thedoingdad.com if you think someone else is using it.

5. Free trial, pricing, and billing

6. Cancelling and refunds [confirm with attorney]

7. Emails from us

Because the daily idea is the service, signing up means you'll get those emails on the days you pick, at the hour you pick. Every email has a footer link to pause or stop them, and we support one-click unsubscribe. We'll also send account and billing emails, like sign-in links and receipts. Stopping the daily emails doesn't cancel a paid plan by itself; cancel your plan to stop charges.

8. Safety and assumption of risk [attorney to review]

Our ideas are suggestions, not instructions. You are responsible for supervising your kids and for judging whether an idea is safe and suitable for your kids, your home, and the conditions on the day.

Some ideas involve things that carry real risk, including heat (stoves, ovens, grills, fires, hot weather), water (pools, lakes, baths, water play), tools (knives, saws, hammers, and other hand or power tools), heights (climbing, ladders, trees, playgrounds), food (allergies, choking hazards, food safety), and outdoor weather (sun, cold, storms, lightning, wind). Our weather-based picks rely on forecasts that can be wrong or out of date. Always check conditions yourself.

Before doing any activity, check that it fits your kids' ages, abilities, and health, including any allergies or medical conditions. Skip or change any idea that doesn't feel right. Follow local rules, product instructions, and posted safety signs.

By using an idea, you choose to do the activity and you accept the risks that come with it, for yourself and, to the extent the law allows, on behalf of the kids in your care.

9. What you share with us

You may give us information about your family and write short notes (for example, what the kids said after an activity). You keep ownership of what you write. You give us permission to store and use it only to run and improve the service for you, as described in our Privacy Policy. Please don't put last names, addresses, photos, or other sensitive details in notes.

10. Our content

The idea library, emails, website, name, and logo belong to The Doing Dad LLC. You may use the ideas with your own family and share an individual idea with friends. Please don't copy, resell, or republish the library or our emails in bulk, or use them to build a competing product.

11. Fair use of the service

Don't misuse the service. That means no signing up other people without their permission, no attempts to break into or overload our systems, no scraping, and nothing illegal. We may suspend or close an account that breaks these terms. If we close a paid account for a reason other than a breach of these terms, we'll refund the unused part of the current period. [confirm with attorney]

12. Disclaimers [attorney to review]

The service and all ideas are provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that any idea is safe or suitable for your family, that weather information is accurate, or that emails will arrive on time or without interruption.

13. Limitation of liability [attorney to review]

To the fullest extent the law allows, The Doing Dad LLC and its owners, employees, and contractors will not be liable for any injury, illness, property damage, or other loss arising from any activity you or your kids do, whether or not it came from one of our ideas, or for any indirect, incidental, special, consequential, or punitive damages.

To the fullest extent the law allows, our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose.

Some places don't allow certain warranty exclusions or liability limits, so some of the above may not apply to you. Nothing in these terms limits liability that can't be limited by law.

14. Indemnity [attorney to review]

To the extent the law allows, you agree to cover our reasonable costs, including legal fees, if a claim is brought against us because you broke these terms or misused the service.

15. Changes to the service or these terms

We may change or stop parts of the service. We may also update these terms. If a change is significant, we'll email you before it takes effect. The date at the top shows the latest version. If you keep using the service after a change takes effect, the new terms apply. If you don't agree, you can cancel.

16. Governing law and disputes [attorney to review]

These terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Utah, unless the law where you live gives you the right to bring it elsewhere. Before filing anything, please email us so we can try to sort it out first.

17. Everything else

If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given up the right to enforce it later. You can't transfer your account or these terms to someone else without our permission. These terms and our Privacy Policy are the whole agreement between you and us about the service.
